This is a plain-English overview. The full legal terms below are what apply.

  • You keep full ownership of anything you upload.
  • Etched never claims copyright over your work.
  • We timestamp your files on blockchain to help you prove when they existed.
  • We do not view or access your files unless you ask us to, or the law requires it.
  • You can delete your files at any time.
  • Subscriptions renew automatically but can be cancelled anytime.
  • Each user gets one free court affidavit if needed.
  • Illegal or prohibited content is not allowed.

1. DEFINITIONS

In these Terms:

  • “Etched”, “we”, “us”, “our” means Etched Tech Limited.
  • “User”, “you”, “your” means any person or organisation using the Service.
  • “Service” means the Etched platform, website, blockchain timestamping, certificates, and related services.
  • “Material” means any files, documents, creative works, or data uploaded by the User.
  • “Token” means a certificate unit used to timestamp Material.

2. USE OF THE SERVICE

2.1 By using Etched, you authorise us to:

  • process and store Material,
  • create cryptographic hashes of Material,
  • record those hashes on one or more blockchain networks,
  • generate timestamp certificates.

2.2 Etched provides evidence tools. We do not provide:

  • legal advice,
  • statutory copyright registration,
  • guarantees of ownership.

2.3 You agree to use the Service only for lawful purposes.

3. OWNERSHIP & INTELLECTUAL PROPERTY

3.1 You retain full ownership and copyright of all Material you upload.

3.2 Etched does not acquire any rights to your content beyond what is necessary to operate the Service.

3.3 You represent and warrant that:

  • you own or control the rights to the Material,
  • you have permission to upload it,
  • it does not infringe any third-party rights.

3.4 You agree to indemnify Etched against any claims arising from Material you upload.

4. CONFIDENTIALITY

4.1 All Material is treated as confidential.

4.2 Etched staff will not access the contents of your Material except:

  • when required by law, or
  • when explicitly requested by you for technical support.

4.3 We store only cryptographic hashes on blockchain, not your raw files.

5. SECURITY

5.1 We use industry-standard security practices.

5.2 You are responsible for:

  • keeping login credentials secure,
  • maintaining backups of your own files,
  • safe use of your account.

5.3 Etched is not liable for loss caused by:

  • user error,
  • device failure,
  • third-party services,
  • the inherent immutability of blockchain.

6. TOKENS & TIMESTAMPS

6.1 A Token represents a batch of files timestamped together.

6.2 Each Token receives:

  • a unique ID,
  • a blockchain timestamp,
  • a verifiable certificate.

6.3 Once timestamped, files cannot be altered.

6.4 Deleting Material does not restore or reuse Tokens.

7. BLOCKCHAIN PERMANENCE

7.1 Users acknowledge that:

  • blockchain records are permanent,
  • hashes cannot be removed once written,
  • this is an essential feature of the Service.

8. SUBSCRIPTIONS & PAYMENTS

8.1 Access begins upon successful payment.

8.2 Subscriptions renew automatically unless cancelled before the renewal date.

8.3 Cancellation instructions are provided in the user dashboard.

8.4 Failure to renew may result in suspension or deletion of stored content.

9. 14-DAY MONEY BACK GUARANTEE

9.1 New subscribers may request a refund within 14 days of first payment.

9.2 Refunds are not available for:

  • previous or returning users,
  • additional paid services,
  • affidavits requested within the first 14 days.

10. AFFIDAVIT SERVICE

10.1 Each User is entitled to one free affidavit.

10.2 Requests require:

  • government ID,
  • court case number,
  • supporting court documentation.

10.3 Additional affidavits may incur fees.

11. PROHIBITED CONTENT

You must not upload:

  • illegal material,
  • adult or obscene content,
  • pirated software or media,
  • malware or hacking tools.

Violation may result in immediate termination.

12. LIMITATION OF LIABILITY

12.1 Nothing limits liability for fraud or death caused by negligence.

12.2 Etched is not liable for:

  • indirect or consequential losses,
  • lost profits,
  • loss of data due to user actions,
  • blockchain immutability,
  • downtime beyond our reasonable control.

12.3 Maximum liability is limited to fees paid in the previous 12 months.

13. WARRANTIES DISCLAIMER

The Service is provided “as is”.
We do not guarantee uninterrupted or error-free operation.

14. FORCE MAJEURE

Neither party is liable for delays caused by events outside reasonable control.

15. GOVERNING LAW

These Terms are governed by English law.
Disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
